KANPUR: Additional special Pocso Act court judge Surendra Pal Singh on Wednesday sentenced accused Sunil Pal alias Chhotu to 20 years rigorous imprisonment under the IPC and the Pocso Act court for kidnapping and physically exploiting a minor girl.
The court in its order directed that out of the fine amount Rs 30,000 be given to the victim. The term which the accused had already passed in jail during his trial would be adjusted in the final term, the court ordered.
According to ADGC Bhawana Gupta, the victim’s mother in a report lodged at the Bithoor police station on May 24, 2018 alleged that her minor daughter, a student of class 8 had gone to her school on May 19, 2018. One Karan Balmiki enticed and kidnapped her from the school. Around 5 pm, when she went to Karan’s house, he told her that he would take her to her house but thereafter he disappeared and after some time his parents too disappeared. During tracking she came to know that Karan and Sunil were friends. Karan had handed over her to Sunil alias Chhotey. The police later arrested Sunil from Delhi and recovered the girl who was in his custody.
In another case, additional sessions judge /Fast Track Court Harendra Kumar Ojha convicted accused Arvind Tiwari alias Arvind Kumar Tiwari to seven years rigorous imprisonment along with a fine of R 7000 for dowry death. The court acquitted Prakash Tiwari, Manish Tiwari, Prem Lata Tiwari , Sony Tiwari and Monu Tiwari, all residents of Azad Nagar for want of evidence.
According to ADGC Omendra Dixit, complainant Rakesh Kumar Ojha alleged in his First Information Report that he had married his sister Sunita to Arvind Tiwari on February 2, 2006 and given dowry and gifts according to his status, but Arvind and his family members, including his parents were not satisfied with the dwry used to torture Sunita for more dowry. When Rakesh Ojha visited Sunita’s house on January 26, 2008, she told him that they would kill her if demands of her in-laws were not conceded.
He received message that Sunita was ill and admitted to cardiology hospital. When Rakesh along with his friend reached hospital he found Sunita dead and her in-laws were not there. During ‘panchnama’ it was observed that she bore injury marks. It was also mentioned in the punchnama that the cause of Sunita’s death was severe injuries inflicted on her and administration of some poisonous substance.
